The legality and/or illegality of the action is determined by the wishes of the artist in question. Many bands (off the top of my head -- Phish, Pearl Jam, Marah, Matthew Ryan, Alejandro Escovedo, Ryan Adams, and of course the Grateful Dead) have allowed fans to record and trade their live shows. As long as the fans only taped and traded no laws were broken, and no harm was done to the artist. Last weekend the Rolling Stones broadcast live from Madison Square Garden, and hundreds of thousands of people taped it on their VCRs. Did they break the law? When you taped Springsteen on SNL, Letterman, Conan, Leno, and Charlie Rose did you cross the same line that the guy who recorded Pittsburgh from behind the stage did? Yes, those performances were broadcast on TV, but so what? What is the *real* difference between sneaking a tape recorder into the Count Basie for the 9/11 benefit to tape the proceedings, and sitting at home the same night and hitting the red button on the remote to record the show on your VCR? It's all the same copyrighted music and performances, so either everybody's breaking the law or nobody is, there's no in between. If it is illegal for fans to record a Bruce Springsteen concert it is only because he wants it to be illegal. That is his right. If someone is suspected of taping a show his people are free to notify the authorities, file a complaint, and/or eject the individual from the venue. They are NOT free to demand identification, steal the fan/taper's personal property, or assault a suspected fan/taper. Bruce Springsteen has spent much of his career exploring the differences between what is legal and what is right, but on this issue he seems to have lost his way. Not everything is about money, not everything is a zero sum game. Just because I got a great copy of Greensboro for free from a fellow fan doesn't mean that Bruce has lost anything in the deal. 98% of the people who tape his concerts are passionate fans who only love the music, and don't want to see these amazing performances lost and forgotten. They record shows as best they can, they make copies for friends and other fans, and they do not sell their live recordings or deal with those who would do so.
